History of the Commission
Created by Chapter 127, Acts of the Legislature,
Regular Session, 1937; Reestablished by Chapter 245, Acts of the Legislature,
Regular Seesion, 2002; consists of five members appointed by Governor, by
and with advice and consent of Senate; bipartisan; term, four years; each member
must have been a resident of this state for at least six years prior to appointment
and remain a resident during the appointment term; one citizen member; four
members must have been licensed and practiced in this State as a Broker, Associate
Broker or Salesperson as his or her primary vocation for a period of not less
than ten years; one of the four licensed Commissioners must be chosen from
among three nominees selected by the West Virginia Association of Realtors;
Chairman designated by Governor; Vice-Chairman and Secretary selected by Commission
from among own members; receive same daily compensation as is paid to members
of Legislature for interim duties, and reimbursed for actual and necessary
expenses incurred; Commission to supervise and regulate the business of persons
who, for compensation, list, sell, purchase, exchange, option, rent, manage,
lease, or auction any interest in real estate for another; and to have charge
of issuance and revocation of licenses of real estate Brokers, Associate Brokers
